Competition sponsors and organisers require the right to use submitted images for publicity purposes and to promote future competitions, however, many, if not most photographic competitions seek to obtain rights well in excess of those actually needed for publicity purposes. Claiming excessive rights in photographic competitions can enable the creation of libraries of images free of all licensing constraints, such practices are damaging the viability of photography as a profession. Pro Imaging have set out conditions for photographic competition organisers and sponsors to be guided by when constructing terms and conditions for their competitions. We call this set of conditions The Bill of Rights for photographers. Pro Imaging believes The Bill of Rights offers contest organisers all the rights they need to run a contest and at the same time its provisions protect photographers rights. Our intent is that it should be adopted as a standard code of practice by all contest organisers. In this section you will find the rules of the Bill of Rights for Photographers, followed by details of the Notification Letter that is sent to competition sponsors and organisers when their competition fails to meet all of the tests we set out in the Bill of Rights. Pro Imaging review photographic competitions, comparing the competitions rules to the conditions set out in The Bill of Rights. Competitions which adhere to all The Bill of Rights conditions will be added to a competition list entitled The Rights On List. How the Bill of Rights scheme worksThrough our own researches and from information supplied by the public to Pro-Imaging we investigate competitions rules. When we find competitions with rules that fail to meet, or it is not clear that they meet, all the conditions set out in The Bill of Rights, we prepare our competition report, put it on The Rights Off List and send to the competition organiser concerned a notification email and a link to our report. The organiser is offered the opportunity to correct anything that is not factually correct in our report in case we have made any errors. If an organiser adjusts the rules of their competition to comply with the The Bill of Rights conditions, as soon as these adjustments are uploaded to the contest website the competition will be placed on The Rights On List, a list of competitions which Pro-Imaging recommends to photographers. If at anytime after a competition has been placed on the The Rights Off List the rules of the competition are changed, Pro-Imaging will be happy to review the competition's rules again providing we are notified by the competition organiser that they have made changes.
