The Rules of this Contest

Listed below are extracts from the rules of this competition. These extracts detail the rights being claimed from entrants.

"Unless otherwise stated, the competition is open to all residents of the UK aged between 18 and 30, except employees of HELLO! Magazine Ltd (HML), hellomagazine.com (HMC), Getty Images Gallery (GIG) and Nikon UK (NUK) and their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with this competition, including the third party promotional partners. Entries from other locations outside the UK will be considered for publication in HML or on HMC, but will not be eligible for prizes."

"Entries will not be returned and no pictures will be retained beyond Friday 31st October when all entries will be destroyed."

"Entrants will retain copyright in their submitted entries; however, by entering, all entrants give HML, GIG and NUK a worldwide royalty free perpetual licence to edit, publish and use all or segments of each entry in any and all media (including print and online) for publicity and news purposes relating to this competition and to the publicity and promotion of this competition in future years. In particular, all entrants license HML the right to publish their entry on HMC and in print. Where an image is used, the photographer will be credited. Publication of any entry does not necessarily mean that the entrant has won a prize and no consideration shall be due or payable, or compensation awarded, in the event of publication without any prize being awarded."

Results of Testing the Rules

Listed below are the results of the tests we carried out on this competition's rules. The tests are all based on the standards set out in The Bill of Rights. By adopting these standards competition organisers can create competition rules that meet the needs of organisers and are fair and respectful to the rights of entrants. For each test a result is given which can be Pass of Fail. Competitions that pass all these tests go on The Rights On List, those that don't go on The Rights Off List.

If the rules are vague and we cannot determine whether the rules pass a particular test or not the result is shown as Unclear.  Where a test is not necessary the result is shown as N/A.

  • Pass, All photographers entering the contest retain their copyright
  • Pass, The contest does not require any entrants to waive moral rights
  • Pass, A credit is always given to the photographer when the image is published
  • Pass, All the documents that must be completed by each entrant to participate in or win a contest are shown

2 Free Usage Durations Claimed

3 Commercial Usage Rights Claimed

  • N/A, Commercial usage is rights managed & time limited as per The Bill of Rights
  • Pass, Entrants are not required to sign commercial usage licenses

4 Declarations

  • Pass, The organisations that acquire rights are all named
  • Pass, This (or last) years Judges are named along with brief bio details

5 Contest End Date

  • Pass, The contest end date is within 16 months of the contest being announced

Conclusions

This contest fails The Bill of Rights because -

The rules of this contest are confusing, on the one hand the rules say that all entries will be destroyed on 31st October 2008. On the other hand the rules claim "worldwide royalty free perpetual licence for the promotion of this competition in future years." They cannot both be true!

Before entering this contest contact the organisers and get this confusion in the rules clarified.

This contest is not recommended until the rules are clarified.
