The Rules of this Contest

ImageListed below are extracts from the rules of this competition. These extracts detail the rights being claimed from entrants.

"License

Entrants retain the copyright for their photos!

By entering the Contest, all entrants grant an irrevocable non-exclusive, worldwide, royalty-free license to Jamtopia and Jambase, Jambands.com, and Relix, and Bob Minkin Photography ("Authorized Parties") to reproduce, publish, promote, distribute, and publicly display the entry (without limitation or further compensation to entrant) solely and exclusively in connection with the Contest and promotion of the Contest, in any media now or hereafter known, for a period of no more than 5 years from the date of the announcement of the winners.

Any use of the entry as described above will include name attribution to the entrant.

Additionally, by entering, all entrants grant to Jamtopia and Authorized Parties the unrestricted right to use all statements made in connection with the Contest solely and exclusively in connection with the Contest and promotion of the Contest for a period of no more than 5 years from the date of the announcement of the winners.

For any usage of entries or statements beyond this 5 year period, Jamtopia and Authorized Parties will seek the permission and agreement from the entrant before using their image(s).

Entries will not be used in commercial products or merchandise nor licensed commercially. Should commercial opportunities arise, the entrant will be notified and will be free to negotiate terms independent of the competition. Entrants may decline any commercial usage license offer and such action will not affect their chances in the contest."

"If Jamtopia elects to cancel or terminate the Contest, Jamtopia will not retain any rights to the submitted photographs."

Results of Testing the Rules

Listed below are the results of the tests we carried out on this competition's rules. The tests are all based on the standards set out in The Bill of Rights. By adopting these standards competition organisers can create competition rules that meet the needs of organisers and are fair and respectful to the rights of entrants. For each test a result is given which can be Pass of Fail. Competitions that pass all these tests go on The Rights On List, those that don't go on The Rights Off List.

  • Pass, All photographers entering the contest retain their copyright
  • Pass, The contest does not require any entrants to waive moral rights
  • Pass, Rules state a credit is always given to the photographer when the image is published
  • Pass, All the documents that must be completed by each entrant to participate in or win a contest are shown

  • Pass, A statement clarifying the commercial usage position is present as per The Bill of Rights
  • Pass, Commercial usage is rights managed & time limited as per The Bill of Rights
  • Pass, Entrants are not required to sign commercial usage licenses

4 Declarations

  • Pass, The organisations that acquire rights are all named
  • Pass, This (or last) years Judges are named along with brief bio details

5 Contest End Date

  • Pass, The contest end date is within 16 months of the contest being announced

This contest meets every requirement of the The Bill of Rights.
