The Rules of this Contest

This is published on the MyCentralJersey.com website primarily as a straighforward appeal for pictures. Pro-Imaging treat such appeals as competitions in which the prize is getting your image published and freely used for ever by MyCentralJersey.com without payment.

Listed below are extracts from the rules of this competition. These extracts detail the rights being claimed from entrants.

"Your License to Us. By posting or submitting any material (including, without limitation, photos and videos) to us via the Site, you are representing: (i) that you are the owner of the material, or are making your posting or submission with the express consent of the owner of the material; and (ii) that you are thirteen years of age or older. In addition, when you submit or post any material, you are granting us, and anyone authorized by us, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, sell, exploit, create derivative works from, distribute, and/or publicly perform or display such material, in whole or in part, in any manner or medium, now known or hereafter developed, for any purpose. The foregoing grant shall include the right to exploit any proprietary rights in such posting or submission, including, but not limited to, rights under copyright, trademark, service mark or patent laws under any relevant jurisdiction. Also, in connection with the exercise of such rights, you grant us, and anyone authorized by us, the right to identify you as the author of any of your postings or submissions by name, email address or screen name, as we deem appropriate."

Results of Testing the Rules

Listed below are the results of the tests we carried out on this competition's rules. The tests are all based on the standards set out in The Bill of Rights. By adopting these standards competition organisers can create competition rules that meet the needs of organisers and are fair and respectful to the rights of entrants. Conclusions

This contest fails The Bill of Rights because -

If you submit an image to this contest, although you can continue to license your image non-exclusively, you will lose forever the right to exclusively license your image. However, MyCentralJersey.com, and anyone else they authorise, have gained the right to use all submitted images for ever in any medium they choose.

At the point of uploading there is no checkbox that entrants must tick to indicate their agreement with the terms and conditions that they must submit to. Such a practice cannot be condoned, the image rights being acquired should be clearly visible prior to uploading.

This organisation is owned by the Gannet Company who in turn control a vast number of newspapers and several subsidiary companies.

We are unable to recommend this competition.
