Photo competitions and image appeals are notified to us by our contributors from around the world. Listed below are some photo competitions or image appeals promoted by the above organisation which have not met the standards set out in the Bill of Rights.

If the terms and conditions of a contest or appeal fail to meet the standards set out in the Bill of Rights the organisation is added to the Rights Off List and a report such as this produced. We have listed in this report the terms and conditions which failed the Bill of Rights to help the organiser carry out a review. The extracted terms and conditions are shown below in italics.

For advice on why failing to meet the standards set out in the Bill of Rights is a serious issue please read this article.

If at some future date a competition organiser decides to join the Bill of Rights Supporters Group, thus ensuring that all their contests will comply with the Bill of Rights, Rights Off reports for that organisation will be unpublished.

The purpose of the Bill of Rights Campaign is to provide education to the public about the value of rights and to encourage photography competition organisers to adopt the ethical practices set out in the Bill of Rights.

Lonely Planet – Pikeo Photo Competition

Closing Date 8th September 2008

RULES

Note the following warning on the competition website -

"Warning: This is a translation of the French rules. Only the French version of the rules is legally binding."

Listed below are extracts from the English translation of the rules, the French version of the rules can be read here.

"4. Terms and Conditions of Participation

Participation in the Competition involves unreserved acceptance of these regulations in their entirety, the rules of ethics currently in force on the Internet, as well as laws and regulations applicable to competitions currently in force in France."

"5.1 Prizes to be awarded

31 prizes will be awarded for a total value of 6337 euros, inclusive of VAT (euros inclusive of all tax).

  • 1st to 4th prize: the first prize winners will each have the opportunity to have their photo published on the cover of the guide for the corresponding city (subject to a separate agreement between each winner and Lonely Planet).
  • Each winner will also receive a trip from Intrepid Travel (http://www.intrepidtravel.com/). Prize value: 1255 euros inclusive of VAT

5.2 Delivery of prizes

Winners will be advised by email of the prize they have won, at the email address indicated in their Pikeo account and will be asked to indicate their postal address for delivery. The 1st to 4th place winners will be requested to authorize Lonely Planet to publish their winning photo on the guidebook cover (subject to a separate agreement between each winner and Lonely Planet). In addition, the list of winners and their photos will be displayed on the page dedicated to the LONELY PLANET – Pikeo competition on the Pikeo site at http://www.pikeo.com.

6. Advertising

The Organizer reserves the right to organize any promotional operations and publicity events related to the present competition.

In this event, the Organizer shall request the authorization of the winners to reproduce and use their first/last names, address and winning photographs in such operations without this use giving rise to any exchange other than the prize won."

Note that winners are required to complete a document containing terms and conditions that are not shown on the contest website. However, the contest terms and conditions state that participation in the contest "involves unreserved acceptance of these regulations in their entirety", but since not all regulations and terms that may affect entrants are on display when the entrant has to submit to this requirement, this is unfair, and would not be acceptable in any normal business transaction.

The Bill of Rights Standards for Photography Competitions

Competitions which meet all the standards set out in the Bill of Rights do not do any of the following -

We have written an Organisers Guide to the Bill of Rights to help organisers draft terms and conditions that respect the rights of entrants and at the same time provide legal protection for the organiser.
