The Rules of this ContestListed below are extracts from the rules of this competition. "5. The winning image will chosen by the Digital Editor and the winner notified by telephone or email within 7 days of the closing date. 8. Each promotion is subject to the specific directions and, if applicable, any terms and conditions published for the relevant promotion in the Evening Standard or on this website. In the case of conflict between these rules and such specific directions/terms and conditions, these rules shall prevail. By participating in any promotion, you are deemed to accept these rules and the specific directions/terms and conditions applicable to the relevant promotion as well as any terms and conditions of any relevant third party. 17. Publicity may be given to promotion winners and winners' names and images may be published in the Evening Standard and on this website and other website(s) relating to the promotion. Winners must co-operate fully for publicity purposes if so required."
Pro-Imaging Comment - The statement, paragraph 17, concerning how the images will be used has no time limit and the maximum permitted by the Bill of Rights is 5 years. Nor does paragraph 17 make it absolutely clear the images will be used solely and exclusively to promote this specific contest and no other purpose. Paragraph 8 requires entrants to agree to the terms and conditions of relevant third parties, but no details of third party T&C's are published on the competition website. It is unacceptable to ask anyone to agree to T&C's they are unable to read beforehand. The rules do not make clear that every time the image is published that the creator will be credited It is not clear what the statement "Winners must co-operate fully for publicity purposes if so required." means. Could this mean signing documents granting image rights to the Evening Standard or to Westfield London? This competition is not recommended.
