Traffic Light Stop signPhoto competitions and image appeals are notified to us by our contributors from around the world. Listed below are some photo competitions or image appeals promoted by the above organisation which have not met the standards set out in the Bill of Rights.

If the terms and conditions of a contest or appeal fail to meet the standards set out in the Bill of Rights the organisation is added to the Rights Off List and a report such as this produced. We have listed in this report the terms and conditions which failed the Bill of Rights to help the organiser carry out a review. The extracted terms and conditions are shown below in italics.

If at some future date a competition organiser decides to join the Bill of Rights Supporters Group, thus ensuring that all their contests will comply with the Bill of Rights, Rights Off reports for that organisation will be unpublished.

The purpose of the Bill of Rights Campaign is to provide education to the public about the value of rights and to encourage photography competition organisers to adopt the ethical practices set out in the Bill of Rights.

Appeal for image donations made at 1:44pm on Thursday 15 April 2010

RULES

This was not a competition, just an appeal for images, as a charity would. On Thursday 15 April the The Bournemouth Daily Echo said-

"A "spectacularly red sunset" has been predicted this evening by Dr David Rothery, a volcano researcher from the UK's Open University, due to the volcanic ash drifting across the country. Get your camera at the ready, and if you get the chance to take a picture, we’d love to see it. We looked at the terms and conditions to see what they would do with these photos, this is what happens -

11. Your responsibilities

You are legally responsible for material you post or submit and you understand that by doing so you intend it to be published on the website. Such material may include without limitation words, artwork, pictures (still or moving) and sound. You give us free of charge the non-exclusive, sub-licensable right to edit, delete, copy, translate, create derivative works from, publish, broadcast, transmit, distribute, perform, make available to the public or otherwise use and re-use material contributed by you (or not use it) on the website and its community forums, reader comments and blogs and associated publications, and in any other media (now known or later developed) worldwide for the full term of any rights that may exist in your contribution (including any renewals or extensions) and you waive any moral rights in your contribution for these purposes.

13. You acknowledge that all rights, including copyright and database rights, for any content on the website (including Newsquest trade names and logos) or which is submitted by you belong to us or are licensed by you to us for the purposes in 11 above.

PRO-IMAGING COMMENT

That seems quite clear, you give Newsquest Media Group the right to use your submission to them for ever, in any way they like, without payment, and you lose your moral right to object to how your submission may be used.

However paragraph 13 seems to indicate that Newsquest even claim the copyright for anything you submit. If our reading of that paragraph is correct, and we believe it is, then you could be sued by Newsquest Media for using your own photograph without first obtaining their permission.
