About this Organisation

Traffic Light Stop signACP Magaines (formerly Australian Consolidated Press) claim that they are Australia's leading magazine publisher with over 60 titles including The Australian Womens Weekly, Womans Day and Australian Geographic, in total selling in excess of 106 million magazines a year. 

ACP Magazines is the magazine arm of PBL Media, Australia's leading media and entertainment company. PBL Media was formed in 2006 as a 50:50 joint venture between Publishing and Broadcasting Limited and private equity fund managers CVC Asia Pacific Ltd. At the tme of writing this report CVC Capital Partners have acquired a 75% stake in PBL Media and currently own 53 companies worldwide.

About this Report

Photo competitions and image appeals are notified to us by our contributors from around the world. Listed below are some photo competitions or image appeals promoted by the above organisation which have not met the standards set out in the Bill of Rights.

If the terms and conditions of a contest or appeal do not comply with the standards set out in the Bill of Rights a report such as this produced and a link to it is added to the Rights Off List. We have listed in this report the terms and conditions not in compliance with the Bill of Rights to help the organiser carry out a review. The extracted terms and conditions are shown below in italics.

If at some future date a competition organiser decides to join the Bill of Rights Supporters Group, thus ensuring that all their contests will comply with the Bill of Rights, the Rights Off report for that organisation's competition(s) will be unpublished.

The purpose of the Bill of Rights Campaign is to provide education to the public about the value of rights and to encourage photography competition organisers to adopt the standards set out in the Bill of Rights.

RULES

2. By submitting the photograph using the email address provided, you agree to licence all rights to use the photo to ACP Magazines on a royalty-free and non-exclusive basis.You provide ACP Magazines with the right to use, reproduce, modify, and publish the photo for any purpose, without renumeration, compensation, restriction or liability.

PRO-IMAGING COMMENT

  1. Rule 2 enables ACP Magazines to modify the entrants images without restriction, in effect denying the entrant his moral rights. The Bill of Rights does not permit this.

  2. The terms and conditions do not state that the entrant will always be credited when his work is reproduced.

  3. All entrants, whether winners or not, are granting ACP Magazines use of their work for ever, the Bill of Rights requires a time limit on usage to be set.

  4. All entrants are granting the sponsor usage beyond that needed to promote the contest, images will be used for other purposes. The Bill of Rights requires usage to be restricted to promoting the contest, and no other purpose.
